A PRISON officer who shot dead a handcuffed inmate who was trying to escape from a Melbourne hospital will not stand trial for murder.
Fabrizio Federico, 29, was charged with murdering inmate Garry Whyte, 39, who was fatally shot in front of staff in the corridor of St Vincent's Hospital on May 7 last year.
But after a committal hearing in the Melbourne Magistrates Court, Magistrate Peter Mealy ruled there was no evidence upon which Federico should be committed to trial.
